Relief India Trust, the Scam NGO, Files a Legal Notice Against my Blog Post for Defamation

From when I wrote my last blog post on Relief India Trust, there have been consistent efforts to take my site down through dubious legal means, the latest of which is a defamation legal notice against me by the Relief India Trust folks. Here’s a factsheet:

  • I received a mail on 9th February, 2013, and also a ton of calls earlier to this date asking me to donate to a charity named Relief India Trust. The people on the call were extremely pushy and while initially I thought it was because of the urgency of the case, I quickly became suspicious. When I started asking them about their NGO registration number, their 80G registration etc. they hung up the phone and stopped responding.
  • I wrote the blog on 13th of February, and it immediately started accumulating comments from lots of folks who had similar experiences.
  • I forgot about all of this until somebody else at the organisation called me up again. I replied that I knew this was a scam, and they hung up immediately.
  • In June, I received a call from a journalist working for The Sunday Guardian asking me further details about the Trust. She also visited their office and informed me that there weren’t any kids there, “only a lady who gave us a long brief about the ngo and so forth”.
  • August 5, I received an email from a person claiming to be from RIT and claiming that somebody else was calling on their behalf. I don’t understand how this can be the case because they ask us to donate by going to the same website. Unfortunately I was so disgusted that I did not reply to this message. That mail is available here.
  • In September, another person emailed me saying they had received a take down notice.
  • In Nov of 2013, I noticed that my blog was not loading. When I contacted my hosting provider (wordpress.com), they said my site was under a DDOS attack. Please see my conversation with my hosting provider.
  • In the Jan of 2014, they filed a DMCA complaint against me with my hosting provider and took down my site until I could file the counter notice. As many of you would know, DMCA notices are used to report copyright violation, so this was definitely a tactic to take my site down.
  • The latest action from their end is this threatening legal notice I received this week.

India’s defamation laws aren’t exactly the most progressive, but in the interests of not letting such dubious “Trusts” get away with anything, I asked around on Twitter for any lawyers willing to provide some legal advice. Anoop reminded me about my school senior Aju who now runs MyLaw.net and he in turn connected me to Apar of Advani & Co who is now representing me. My initial interactions with Apar were through Twitter, and he’s been a pleasure to talk to. Find Apar’s response here, wherein he manages to quote Arkell vs. Pressdam 🙂

Update (October 27, 2014): I haven’t heard back from them after the notice was replied to, but wanted to update all of you on certain new developments thanks to comments on this post:

  • Read the official AIIMS policy on donation & abide by it.
  • Relief India Trust now has a listing on the NGO registry, to reach this page yourself, go to the NGO home page and put in 0081349 on the home page. This however, doesn’t mean a thing, as we should ask for audited financial statements for authenticity. Anybody can start an NGO.
  • Please find uploaded here a list of fake documents they send across when asked for proof. Note that most of these are outdated, and some are outright photoshopped.

    I ended up donating these people around 5000-6ooo on three occations in totality.
    They did mail me some tax related documents and recipts but I did not go through them properly. I realized my mistake when I started getting persistant calls. Each and every time it was some kid they wanted help for that too in emergency.

    Why the hell in India people have this habit of taking this emotional advantage. I wont donate anyfurther to any organization now. I have lost faith in such institutions.

    Even today, I ended up paying 630 for something that could have been bought for 150-200 (which i came to know later when I cross-checked the price). This lady who came at my place was almost in tears and asked me to buy something from her lot.

    Pathetic people!

      I too received a call from relief india trust and ended up paying Rs 6000 to them and didn’t receive any receipt yet.

    Please do something with this frauders,

    I got two calls from Kunal and Piyush, and i dontated around 1000/- rupees and now Piyush is behind me.

    That he want to help sonu a 3 year old kid, but i found the Sonu 14months name already in successful story, I am not able to decide it.

    Mr. Piyush called me and said
    he want to help sonu where he need 2 injections, out of 7(injection cost 5250/-), where the two injections have to give today to save sonu, and hez running of out of time, said already his father given 20000/- for this child.

    In second call he said hez falling 3 injections out of 6 injections for sonu… Then i started googling, found your blog.

    I request you please do something with RELIEF INDIA TRUST, so that money will be routed to correct NGO’s.

    I hear the call center people are fully engaged in getting funds. I can hear there background sounds….

      While surfing for the Releief India Trust to donate in response to a long essay by SMS once again soliciting donation by one Ms Mahak Sharma I happen to see another link talking of “Relief India Trust Scam”. So I got curious and saw your blog and got wiser. I have always been confounded by this approach and have been wondering about this unparalleled dedication of the volunteers. Though I have donated in the past several times but I am not donating now. Thanks very much.

        If I am not wrong this is total fake…. otherwise…. You might have opened both the NGO and call center, and trained the employees with commission based…. If you get 1000/- then you might be really helping the children with 300/- and 700/- in your pocket….

        I have question, your call center person Mr Piyush, In First call he said his father has given 20000/- and he is short of 2 more injections i,e 10,500 and after 15mins again I called him to take more information on kid named Sonu condition again he said he is getting short of 3 Injections which is 15,750,.. Then felt Fishy.. finally found this blog… Thanks to Venu Gopal….

        Sonu is already in your successfully treated Childrens List.

        How sonu ill again, and getting same kind of treatment again…
        Your Prescriptions from AIIMs are not showing correct information and hiding prescription by keeping yellow pages, and most of them all are 2012 prescriptions…

        If I have an authority or I am in delhi,… definitely i Could have taken your roots….

        Anyway today or tomorrow your story and NGO will be in news channels…

    Even I got a call today from a girl saying she was calling from Relief India Trust. And a boy named Sonu was battling with a heart disease. At first she asked me if I could donate. I said I couldn’t since I am studying in college. She then told me to pay whatever I could and agreed when I said I would manage to pay a couple of hundred bucks. And she went on to tell me the procedure to make the donation. It sounded fishy to me, and I told her my net was not working properly. She said she could hold and I should give it a try. After just acting like my net wasn’t working for a few minutes she started having a casual conversation with me. Where I told her I was from Mumbai and she told she was a volunteer studying in DU doing BA Naina. After just casual talk and holding the call for 15 minutes I told that as soon as it’s done I shall call her. In the meanwhile I googled and found out through various sites that this was some kind of a fraud.I received a message from the same number stating the procedure. After half n Hour I received a Call stating that I hadn’t sent her the transaction Id. I acted a fool again stating the donate button wasn’t working. She gave the call to one of her co-workers named Manish Negi. I told him that my button wasn’t working & it would not click. I also asked him of the child and where he was admitted, the answer was AIIMS and cost for the operation was 1.5 lakhs. I told him since the button wasn’t working I would like to pay him in person for which he agreed. He asked me where I stayed, I told him a Lie again stating I was in Noida. He gave me an office Address which was the same as stated on their website. I asked him a few question on what he does?. What amount is needed? How much has been paid? He had some hesistence in his voice while saying things. He took time to think and said it. At the End of the discussion he told me at least to pay some of thousand rupees online so it covers the cost of a day for sonu. I somehow promised him I would show up tomorrow at his office and pay and he willingly agreed. I asked him since he was just a college volunteer I would like to meet someone from the trust itself. He told me to meet someone called Dr. Monica. When I asked about the last name he didn’t know.

    Strange Things I noticed in the Convo.
    1. These people didn’t seem in a hurry and were willing to wait as long as it takes. Which is very fishy if it is an emergency? So the Cost of their Call is totally paid for it seems.
    2. They did agree when I told them I would like to meet them in person and pay. Which gives me second thoughts if is really a scam.
    3. The Message send by the girl first had her name as Naina Ray. When I asked the boy What her name was He said Naina Negi. The Coincidence was both their lastnames were negi, I casually asked them if they were siblings he denied they were from the same village and district studying in the same class which is also something strange.

    1. I got a call from a volunteer called Rahul bhatt from number 8744053825. He explained about Pratigya girl’s medical condition and kept on asking me to donate. Told me that i have to pay for 2 injections and in comments section i have to mention irch-100101676. I didnot pay immediately. When looked for reviews, found that its not a genuine ngo. Luckily i didnot loose my money

      I received the 80G Tax Deduction Certificate in physical copy.

      Moreover i managed to contact A.N Singh from Kalawati Saran Children’s Hospital and got his confirmation on Baby Praveen’s presence and Relief India Trust assistance to him.

From last three days I am getting call twice or thrice a day and they are asking me for donation, I am already associated with few NGO’s and I know a genuine NGO volunteer never push you forcefully for donation. Due to their call frequency I realized there is something fishy so I googled it. A very BIG THANKS to YOU Vishnu.

    And now as I have all info, it will be fun talking to there volunteers…. :-p

    I too received a call from these guys. Name Amit ; Number 9211516929. I told him my number is in DND and i will lodge a complaint against him. He said “Go and do whatever you can”. It seriously irritating

      I too have been receiving calls from this institution. They call about 10 times everyday. If you don’t pick up one number, they will call from a new number. They openly ask the amount you are going to give i.e 1000 and then keep saying make this 5000 or 6000.. try to get from others and make donation today itself as it is urgent.

  9. Got a call today from number 9211243798 telling the same case about baby Pratigya and on refusing to entertain them further, the fellow started using emotional blackmail.
    On threatening to complain, arrogantly, he asked to go ahead.
    Really want to do something to give them a slap back hard.

    I have unwittingly donated 7k to them.
    A lady identified her as Dipali called from +919871172050 and told story of Master Praveen’s treatment.

    I have instructed her to offer the refund after reading your blog.
    She sent several discharge summaries to prove their organizations’s merit.
    She has also sent me the unique id of the organization as 0081349 and now it shows up in ngo.india.org

    I have contacted a doctor in AIIMS over email to cross check their validity, and i am yet to receive a reply.

    Now what can i do? Please suggest some ideas to prove them as fake so that i can take it forward.

        The email you received has a slip from 2011 with an image of the “baby” photoshopped onto it. Most of the other documents have dates from 2012 & 2013. A few have dates from 2014, but it’s early Jan, Feb or March.

        These are fake. Please let me know what you hear back from the hospital.

      4. I couldn’t contact the hospital and i just contact doctor.
        I am yet to receive a response from him.
        They are insisting that they have now became a government authorized NGO and have registered their rationalization as a non profit organization in income tax department to exempt from Tax.

        Now, just tell me what evidence i can ask to make sure that the donation i have made went directly to Hospital or needy instead of being misused.

        Or just let me know what reason i can give for me to request a refund from them or to pursuit other options to get back the money.

      5. I would suggest you reach the hospital somehow because that’s the best way to validate this. Sorry I can’t help more!

        If you’d like to pursue legal options, contact a lawyer to know your options.

I got call for some donation, just after picking the call she started telling me the story of an old man who need medical help, when I asked them why you need money for medical help give me patient name, phone number and hospital addres, I will personally meet and make payment if required they said they send me the message which I am still waiting

    Thanks Vishnu for the inititative & bringing light on ths NGO. Last month end I received a call from some girl asking for immediate money to help a 14m old baby having a hole in the heart & needs urgent operation. On the call she took me thru the website Support a life > some baby > & literally forced me to click on Donate now. She said out of 1.5laks, 60K is to be collected. Thinking its a genuine NGO & baby is critical I made a tranfer of 2500/-. After 2 hours she’d called up again saying hospital ICU per day charge is 5300/ & if I can pay the remaining she can stay in ICU for a day in my name. That was EMOTIONAL BLACK MAIL, I felt later, after donating 5300/- in total.
    I donate to other NGOs like http://www.desiresociety.org who are very genuine while calling & asking for donations. They call only once a year, likely at the start of school, 1500 for education/food for one child/year & other packages. Donars are free to donate whatever they like. Not forced & emotionally black mailed. They have about 30 HIV infected kids. Videos, their progress available on their site.

    The reason for this writing is, after 12 days of donating 5300, I got another call from a guy – same story repeated – 5m old baby – ICU. He was like, I know you’ve donated 10days back, but pls consider this small boy, his parents cannot afford, etc. I was with myself thinking, ‘Boss, If I keep donating, someone point later someone else has to donate me’.. Some how managed to not pick up his call that day agian, then googled for this NGO & stumbled upon this. I’ve got some 10+ calls the following day which I did not pick up, knowing its them. Damn. There are govt hospitals all over. Dont they have policies to help these kind of kids, if they’re genuine ?

        Signed by B.L Meena (Googled & theres a official by this name from Delhi) & 3 Stamps by Director of Income tax, Delhi. Were these forged ? How can an IT office outright – keep on sigining these kind of documents. I could upload them some where if needed.

  14. Today, I got a call from a girl calling herself to be Shivani. The no is + 91 92 11 268503. The patient is a two year old girl called Pratigya Kumari and she has to be adminstered chemo, failing which she will die. When I asked them to share with the ward no and bed no; they refuse. What should I infer from these.

    How do we get your page back in search results ? I’ve come here by clicking the ‘omitted’ results. I was getting calls and i never paid after reading all these reviews. Today, they were too harsh. Is google your GOD?, Do you believe Govt or Google. Then I asked ‘are you a goverment organization’ to which they replied ‘yes’ and told me to type ngo.gov.in or something. I asked him to tell the full form of NGO. He initially resisted and later said Non-Goverment Organization. I blasted him left & right. He said ‘it is not your child and that is why you are not worried’. I told him to get lost !

    I want these kind of pages comes up in first page of google the moment they search Relief India Trust !

    I will tweet to Hindu & ibn asking them to read this blog and remove their article from website ! Such a shameless guys !

    I got a call for same girl Pratigya Kumari from a girl named Garima from 9210810794. I don’t know what the hell are they doing. This kind of situation lead to overlook of genuine cases. They will go to hell and burn in future.

    I received a call from Relief India Trust regarding a little girl of 2yrs age who is suffering with some sort of cancer. The “volunteer” on the phone seemed to be on the verge of crying it seemed.. sort of very helpless.. She asked me how much I could donate, etc.
    I asked her how she got my number ? She said: RIT has drop boxes at its camps where people can drop reference numbers so that potential donors can be brought in.. I however was a bit skeptical, I did a google search and stumbled on this blog! The “volunteer” even sent me text messages requesting donations.. I really don’t know what to do!

    The child she referred to: Pratigya Kumari, I checked her details out on their website.. full of scanned copies of prescriptions and bills.. After reading this blog, I think it would be safer if I wait sometime before donating to these people..

    3. Same ! I got a call just now from +91 9211248945. They referred to this 2 yr old Pratigya Kumari and also her info on their website and they where very persuasive asking me to donate for her else she will lose her life. They kept calling back and were very keen to getting the donation soon.

    I too got a call just now, i asked them where did they get my number from and the lady got confused and other female took the call and she started persuading me, i got skeptical and told them i will go through their site and get back, and found your blog, thanks Vishnu for the awareness.

    Hi, I too got a call from the same Relief India Trust for the same child, Pratigya Kumari and yes, while they are very pushy, what I normally do in all cases where I wish to donate, I do call the hospital to reconfirm. In this case, I did call AIIMS and spoke with the gentleman in the concerned department and AIIMS especially does not entertain NGOs, for financial help the AIIMS staff Social Welfare Department itself pursues to collect the funds. RIT definitely seems to be a scam and people should be careful before they give them money.

    TODAY I GOT CALL FROM RIT (VOLENTEER-ALI KHAN,9211248945) FOR A PATIENT CALLED PRATIGYA AND THEY WANT ASSISTANCE FOR CHEMOTHERAPY.THEY INSISTED ME TO PAY AT THAT TIME BUT DUE TO TECHNICAL FAULT I DIDN’T ABLE TO PAY BUT WHOLE DAY HE KEPT ME MESSAGING THAT PLZ HELP DT CHLD OTHERWISE C WL DIE..WHEN IN D EVENING I TRIED TO PAY THAN THE TRANSACTION FAILED AND SUDDEN I SAW REVIEWS…

    Today I Got a Call from 09289226022 and 9289226017(Rohit), The representative was so convincing that i had made my mind to donate and suddenly it clicked on my mind to check the reviews of the company once and I found these blogs.
    I changed my mind and asked him to mail me all the details of his NGO like registration number, Contact Details, Address and affiliations and he said he will be mailing me in 2 minutes and as expected the mail didn’t come, however he sent me message that he mailed me all details and also he asked me to check Income tax website.

    If such scams would happen and people get fooled then nobody would really appreciate any kind of help for whom they really need it.

    Just got a call from them for the same 14yr old Anchal Yadav suffering from bone cancer. I for one always do a quick background check when money is involved. Googled and voila, your blog came up. So I’ve sent them a text message seeking for the documents missing on their website. Reply awaited.

    I also received a call from this Trust earlier today. While I am extremely ashamed of myself (being a corporate lawyer) to have believed in them and having paid a sum of Rs. 2,000, after I paid the money there was a sense of enlightenment which struck me and I researched more on this. Here are a few points:

    (A) PAN- It does not take much of an effort or verification to get a PAN (people who have a PAN here would know.). You just have to provide your details and “mention” the category under which you would like the PAN to be generated. They did it under Section12 of the IT Act which deals with charitable organisations. And the IT department does not care about the veracity of anything while giving the PAN.

    (B) Newspapers- Well, it would not require too much of intellect to understand this. Paid news/Paid columns?!

    (C) How I found out- I had to lure the +92 scamsters into believing that some other people also wish to donate much larger amounts. But they needed to have some confidence in RIT. So, I would need some credentials of the patient. They were happy to help and gave me the patient ID. After a series of phone calls to different departments of AIIMS, I finally got lucky. And guess what- I was speaking to a doctor, who was actually sitting with the same patient “Baby Pratigya” at that point in time. I gave him the entire background. He was quick- “Its a scam sir.     I am also getting calls from RIT about girl Anchal Yadav and they asked me to search their pan card no(AABTR7683M) in exempted institutions on http://www.incometaxindia.gov.in. They are actually exempted as this says approved under section 12a but I can’t find them in the ngo list on http://ngo.india.gov.in/. I don’t know how this is possible because to get an exemption u must be a registered ngo. When I asked them their ngo registration no. they say that they can’t register with govt before 3 yrs of operation and they have only completed 2.5yrs which I think is false. But still how are they registered with income tax dept under 12a if they are fraud.

    Hello All,
    I received the call yesterday. They called my friend and since I take special interest in such donation frauds, I asked my friend to give my number. They immediately called me and asked to transfer money. I asked them to email me their complete details and their all kind of registration number and affiliations. The lady said ok. I ws busy so I said I will msg back once I receive mail. As expected, Mail din come :D. The lady called me today n I said mail din arrive. She changed topic and msgd me website link. I said I will get back to her later. She insisted me to click donate button when I get online. And kept asking if I ws online can transfer right now.
    I thoroughly did Web research and being a Web developer caught all the loopholes of this fraud.
    Note : 1) there are over 27 websites with similar name and extension. Not one of them have any kind of registration or affiliation.
    2) the Wikipedia article about them popped out few days back n has no back link which means it’s fake n will be taken down soon.
    3) the newspaper links is nothing. I work for a organisation for my university and newspapers publish all and any kind of news, they don’t verify credentials. Even u cn organise few small campaign n get a newspaper story.
    4) the bank account number in transfer is not a NGO type of account.
    5) there’s no financial audit of this organisation.
    There are many more.
    Am going to call back that lady. Ask further details. And most probably would be filing a police complain on the charges of harassment and dubious extortion of money.

    Please spread truth about this organisation so that they can be check mated before they fool any more people.

      They don’t have a secured https:// connection on any of their website.
      They are using fake profiles to increase their ratings in Google maps check in. (the screen shot you see at the top of blog). The rating has dipped to 1.8 even though some back to back 5 star rating with very obvious fake reviews are being made on daily basis there.
      They have alredy duped many people who are not Internet active and don’t search extensively before donations.
      They seem to have a call center type of system to dupe people.
      One person talks with many different names.
      They are using fake low resolution images of suffering kids on their website.
      They have over 30 different websites and none all of them have same or similar content. Why would a genuine NGO have 30+ similar website??

      Share about this scam on ur Facebook and other platforms. You might not be helping a child, but don’t let a genuine donor get duped by these scamsters..! I have fb pages with over 200k followers. I shared everywhere. Incidentally lot of ppl started complaining about the same fake NGO and same story..

    I received call yesterday from some guy named Paras from +91 9211358216, pretending to be studying in DU and doing this charity work in spare time with Relief India Trust. He narrated the similar story – baby Anchal admitted in hospital, urgently needs Rs17,000 for chemo session. Her parents are very poor and cant fund his treatment……. He was extremely emotional and pushy. Somehow I managed to disconnect the call. Next time he calls up, I will rip this scamster apart…

    It’s really pitiful.. a genuine NGO will never have 50 websites for the same purpose…they have it to continue uninterrupted ‘business’ if any site is taken down for some reason. The “legal notice” sent to this blog owner is clearly fake!

    I too received a call just now from a volunteer (Arti Sharma – +919211240651) asking for a donation for a bone cancer patient as listed on their website Anchal Sharma. I wasnt convinced about the details presented and searched on Google to see that many have got calls on similar lines.

    This volunteer was literally pleading not to hang up the call and asked me to do the transfer online immediately which i politely declined. When i asked as to how they got hold of my number, i was told that they got this thru blood donors list, which i found weird.

    I am not convinced by the authenticity of this trust nor the facts that they put across.

  38. i got a call from them just now asking for money for “baby aanchal yadav” suffering from bone cancer etc etc… i told him i work in bangalore n not delhi, to which he replied that they r calling people all over india for this. the guy was like almost forcing me to make some donation as soon as possible. i asked him how do i know that u guys r not fake, after that he asked my email id and sent me their request mail with their website details and other info. I googled some more, found out that this looks to me as fake.

  40. Thanks for the post. Just got a similar call and i wanted to do a sanity check before i even logged on to the site. Your blog definitely helped. I also came across some posts on other blogs that they were formerly called “reliefindiatrust.com”. They have since changed the domain name as a simple whois on my browser is enough to expose their skullduggery.(.org domains are outside common whois purview)

    I also found out that they run a quasi-legal trust cum BPO business model, the focus being on the commercial side of things.

    Anyway, is there no way we could take legal action against them? If for nothing else than maybe we can persuade AIIMS to shut them down for IPR violations

    They have even failed to remove brackets and change time zone from “by [4.00pm GMT] ” text at end of letter. Since they have circulated a document that is about 95% copied from web document without attributing the source, it is itself a violation of copyright.

    Thanks for this! I received the call today and the rep was pushing me to donate. He said it is online transaction only and I will be receiving the tax exemption certificate, the way he spoke made me think if it’s for real. Their website and FB page looks very real. I informed them I will do it online and no need to call me further. The volunteer name is Wasim and he sent couple of text and forcing me to provide the transaction id and the amount so he can prepare the 80G certificate for me. See his text below:

    “just msg txn id so we able to find ur help then we provid u 80g certificat nd al ur document. Thanks godbless u. Pray for baby. Volunteer-Wasim”

    Like you said above, should i ask him for the NGO registration number, 80G registration & audited financial statements? Is this something they can provide to public?

    2. Hi All,

      I also received a call from this Trust earlier today. While I am extremely ashamed of myself (being a corporate lawyer) to have believed in them and paid a sum of Rs. 2,000, after I paid the money there was a sense of enlightenment which struck me and I researched more on this. Here are a few points:

      (A) PAN- It does not take much of an effort or verification to get a PAN (people who have a PAN here would know.). You just have to provide your details and “mention” the category under which you would like the PAN to be generated. They did it under Article 12 which is charitable organisations. And the IT department does not care about the veracity of anything while giving the PAN.

      (B) Newspapers- Well, it would not require too much of intellect to understand this. Paid news/Paid columns?!

      (C) How I found out- I had to lure the +92 scamsters into believing that some other people also wish to donate much larger amounts. But they needed to have some confidence in RIT. So, I would need some credentials of the patient. They were happy to help and gave me the patient ID. After a series of phone calls to different departments of AIIMS, I finally got lucky. And guess what- I was speaking to a doctor, who was actually sitting with the same patient “Baby Pratigya” at that point in time. I gave him the entire background. He was quick- “Its a scam sir. The kid is fully supported by an NGO exclusively and needs no assistance.” He promised to take up the matter with his higher-ups who might be able to take their website down (which also illegally publishes patient medical records on their website).
